If Agaitas special has been used to draw cards from your preys library, can you bury them with the Heart? And you cannot put card taken from your prey library under your own. Two reason for that : * only your card can go in your library * they are considered in your hand to be played and discarded. Not to be put in your library.

That is not the question, the question about the cards you already have in yuor "hand" from agaitas's special.

Even without that, you cannot put them under your deck, so you cannot choose them. The logic is the same as 2nd tradition vs Seduction : since you cannot do the whole package, you cannot do it at all.

Without that, I won't take a guess about something as different as Heart of Niz'. Please note that, even if they were considered in your hand for Heart matter, you would still be unable to put them under your library, so you could not choose them.

Cards that Agaitas has drawn from your prey's library act just as any other card in your hand with two notable exceptions: 1) If a card drawn with Agaitas's special would go to an ash heap, it goes to your prey's ash heap. 2) If a card drawn with Agaitas's special would go to a library, it goes to your prey's library.
