Fragment of the Book of Nod

Can you tap the Fragment of the Book of Nod during a time when cards are not supposed to be replaced? That is, during a referendum or during a turn after you've played a Wake With Evening's Freshness? If so, do you discard down to the number of cards you had, or is your "hand size" still considered to be normal?
