[LSJ] Another Stupid Archon Investigation question

Card text states ..."only usable when a minion is ATTEMPTING to bleed you for more than 3 pool"... Does that mean that this card is only usable when a minion has a default bleed of more than three or if that minion is using an Action bleed? Therefore, a minion with only a default bleed of one taps and attempts to bleed. I choose not to block, he then uses an action modifier to increase the bleed to 4. If Arika was bleeding you and she had previously done a spying mission, you could not burn her because she only attempts to bleed for 3.
