Clan Justicar votes to not automatically name the acting vampire
to be the Justicar, so the Malk in your example could legally
take the action regardless of playing the Mask1K or not.
The Clan Justicar votes say "Choose a ready <clan member>. Successful
vote means that vampire is the <Clan> Justicar." So your Mask'ing
Malkavian would still have to choose a ready Nosferatu.
