LSJ- Parity Shift and Changing Pool Totals

I have 19 pool. My prey has 20 pool and Feraillle. I call Parity Shift and terms are called "4 from my prey to me". The action succeeded and a referendum is called. My prey burns a pool for Feraille. We now each have 19 pool. Does the Parity Shift fizzle at this point in time, or does it only check when the action is successful?
