Yes to both.
The only current errata/clarification/ruling on Legendary Vampire
states the following:
Legendary Vampire [DS] - Unique Master (2)
Legendary Vampire is only usable if the vampire was moved into your
active region during your last influence phase. (Not usable for simply
winning a contest or on stolen vampires) [RTR 19960124]
The first sentence of the card is the one that is important:
Choose a vampire with a capacity above 6 who was moved into
your active region during your last turn.
Does the vampire fit the requirements?
Capacity above six at the time you choose him? Yes.
Moved into your active region during your last turn? Yes.
Therefore, you may play Legendary Vampire on a vampire who left the
inactive region with a capacity lower than seven if that vampire has
gained enough capacity before you play the card.
